Importer Requirements: ISF Importers, or their agent, must provide eight data elements, no later than 24 hours before the cargo is laden aboard a vessel destined to the United States. U.S. bound Cargo (Includes FTZ and IT): requires the electronic filing of an Importer Security Filing (ISF) comprised of 10 data elements.
Those data elements include:
+ Seller
+ Buyer
+ Importer of record number / FTZ applicant identification number
+ Consignee number(s)
+ Manufacturer (or supplier)
+ Ship to party *
+ Country of origin *
+ Commodity Harmonized Tariff Schedule
Two additional data elements must be submitted as early as possible, no later than 24 hours prior to the ship’s arrival at a U.S. port. These data elements are:
+ Container stuffing location; and
+ Consolidator
Transit Cargo: requires the electronic filing of an Importer Security Filing (ISF) comprised of 5 data elements. The following five data elements must be submitted:
+ Booking party
+ Foreign port of unlading
+ Place of delivery
+ Ship to party
+ Commodity HTSUS number
The port you arrived at will file a case with the CBP if you failed to submit the ISF or missed the deadline. In some cases, the port will start the procedure itself rather than passing it along to the CBP. The CBP will then go ahead and report the offenses. If you don’t follow the ISF, they can charge you up to $10,000 in damages.
For failure to file the ISF, late filing, incomplete filing, failure to withdraw the ISF, or failure to ensure it matches the Bill of Lading the CBP can assign penalties of $5,000 per shipment. In some cases, the government agency will hold your cargo until the proper information has been received and reviewed./
